Terms and Conditions

1. General Provisions

1.1 The online store www.ecotoys.lv is operated by SIA Smartstore, Reg. No. 40103807273, Jelgavas iela 63 k-3 -401c, Riga, LV-1004, info@smartstore.lv, tel. +371 24242690.

1.2. When ordering goods from the online store www.ecotoys.lv, a Distance Contract is concluded between the Buyer and the Seller, and the Buyer agrees to the Terms and Conditions of Sale set out below. The Seller reserves the right to amend these Terms and Conditions.

1.3. The mutual relations between the Buyer and the Seller are governed by the laws of the Republic of Latvia.

2. Placing an Order, Delivery and Payment

2.1. Goods offered by SIA Smartstore can be purchased by placing an order in the online store www.ecotoys.lv, calling +371 24242690 or emailing info@smartstore.lv.

2.2. The Buyer must provide their personal details (first name, surname, delivery address, telephone number and email address) so that the Seller can fulfil the order.

2.3. The Seller is not responsible for the accuracy or reliability of the information provided by the Buyer in the order registration form.

2.4. The Seller confirms that the Buyer's data will be used solely for delivery and direct sales purposes.

2.5. The Seller undertakes not to disclose the Buyer's personal data to third parties, except for the Seller's partners who deliver the goods or provide other services related to the Buyer's order. In all other cases, the Buyer's personal data may be disclosed to third parties only in accordance with the procedure prescribed by the laws and regulations of the Republic of Latvia.

2.6. After an order has been placed in the online store www.ecotoys.lv, the Seller will contact the Buyer to confirm the order and provide information about the availability of the goods and the delivery time. If the goods are delivered by courier, the Seller will inform the Buyer of the delivery cost after processing the order.

2.7. If the Customer places an order for a quantity of goods exceeding the quantity of the specified goods in the Seller's warehouse, the Seller will inform the Buyer by telephone or at the email address provided by the Buyer when placing the order. The Buyer may pay for and receive the goods in the quantity available in the Seller's or its suppliers' warehouses, or postpone placing the order until all the goods desired by the Buyer are available in the required quantities in the Seller's warehouse. If the Seller is unable to contact the Buyer to confirm the order within 3 working days, the Seller is entitled to cancel the order.

2.8 If the goods are not available in the required quantity in the Seller's warehouse, including for reasons beyond the Seller's control, the Seller is entitled to cancel the relevant item in the Buyer's Order and inform the Buyer accordingly.

2.9. The delivery time depends on the delivery method selected by the Buyer and the availability of the goods in the Seller's warehouse.

2.10. The Seller endeavours to meet the stated delivery times, but delivery of the goods may be delayed for reasons beyond the Seller's control.

2.11. If the goods are not delivered to the Buyer because they are lost during delivery due to the fault of postal or courier service employees, the Seller will reimburse the customer for the cost of the goods and delivery only after the Seller has received confirmation of the loss from the postal or courier service.

2.12. The risk of accidental loss of or damage to the goods passes to the Buyer when the Buyer receives the Order.

2.13. The available payment methods for an order depend on the delivery method selected.

2.14. Prices in the online store ecotoys.lv are listed in euros (EUR) and include value added tax (VAT). Prices do not include delivery costs.

2.15. If incorrect prices are displayed in the online store, the Seller will inform the Buyer as soon as possible in order to cancel or amend the order.

2.16. The Seller may grant the Buyer discounts on goods. The Seller is entitled to amend them unilaterally.

3. Returns

3.1. In accordance with the Consumer Rights Protection Law of the Republic of Latvia and the Cabinet of Ministers' Regulations on Distance Contracts, consumers have the right to withdraw from the contract within 14 (fourteen) calendar days of receiving the order and return the goods to the Seller.

To exercise the right of withdrawal, the Buyer must inform us, SIA Smartstore, of their decision to withdraw from this contract by means of an unequivocal statement (for example, a letter sent by post, telephone or email). To meet the withdrawal period, it is sufficient for the notice concerning the exercise of the right of withdrawal to be sent before the withdrawal period expires.

3.2. Goods may be returned only if they are complete, retain their original appearance and packaging, and have not lost their consumer properties.

3.3. To return goods, the Buyer must complete the Withdrawal Form and send it together with the goods to SIA Smartstore at the following address: Jelgavas iela 63 k-3 -401c, Riga, LV-1004. The Withdrawal Form is available from the Seller upon request.

3.4. After receiving the returned goods, the Seller will refund the full amount paid for the goods within 14 days. The refund will be made to the Buyer's bank account specified in the Withdrawal Form. The delivery costs associated with returning the goods will also be refunded to the Buyer (except for any additional costs resulting from the Buyer's choice of a delivery method other than the least expensive standard delivery method offered by the Seller).

3.5. In accordance with the Consumer Rights Protection Law, the Seller is entitled to refuse to accept returned goods if they have been used, are not returned in their original packaging, are damaged, have visible defects or are incomplete.

3.6. By commencing use of the goods, the consumer confirms that the goods conform to the order and cannot be returned.

4. Warranty

4.1. We recommend using purchased goods only in accordance with the manufacturer's instructions, their characteristics and intended purpose.

4.2. The Seller is not liable for any losses incurred by the Buyer as a result of improper use of the goods.

4.3. Goods available in the online store www.ecotoys.lv are covered by the manufacturer's warranty, which is specified in the product description or can be confirmed by contacting the Seller.

4.4. Consumers have a statutory right to submit a claim concerning goods that do not conform to the terms of the contract within 24 months of the date of delivery by contacting the Seller.

5. Other Provisions

5.1. Product descriptions and photographs in the online store www.ecotoys.lv are for information purposes only. The colour of a product may differ from that shown in the online store. The Seller is not responsible for the colour settings of the Buyer's display.

5.2. Before placing an Order, the Buyer may contact the Seller to clarify details about the goods. If the Buyer has not contacted the Seller for further explanations, it is assumed that the Buyer had no questions about the characteristics of the goods when placing the order.

5.3. The Seller is entitled to send Buyers informational emails and advertisements. If the Buyer wishes to stop receiving such communications, please email info@smartstore.lv.
